Residence card for a family member of an EU citizen

Residence document for non-EU family members of a Spanish, EU or EEA/Switzerland citizen who is exercising their right of free movement. It is processed under the EU (community) regime, which is faster than the general regime.

Who is it for?

Spouse or registered partner of the EU/Spanish citizen; direct descendants under 21 years old (or older dependents); and direct dependent ascendants of the EU citizen and of their spouse.

Main requirements

  • The applicant is a national of a country outside the EU/EEA
  • The family member is a Spanish citizen or a citizen of another EU/EEA/Switzerland State
  • There must be a family tie with the EU citizen (spouse or partner, dependent descendant or ascendant)
  • The applicant must be in Spain and submit the application within 3 months of entry
  • Have no criminal record in Spain or in previous countries of residence

Duration

Residence card for a family member of an EU citizen, valid for 5 years; it grants immediate access to residence and work.

Usual documentation

  • Official application form (form EX-19) in duplicate
  • Full valid passport of the applicant
  • Documentation proving the family tie with the EU citizen (marriage, registered partnership, birth or dependency)
  • Valid identity document or passport of the EU citizen
  • Documentation proving that the EU citizen resides in Spain (employment or financial means and insurance)
  • Three recent passport-size photographs
  • Proof of payment of the fee (form 790, code 012)

Authority: Immigration Office (Oficina de Extranjería) or National Police Station (Comisaría de Policía Nacional) of the province of residence.
